The Joint Landowners Coalition of New York, Inc. (“JLC”) and several individual petitioners have joined the fight to compel New York State to issue final standards for drilling and high-volume hydraulic fracturing. This is a significant development because the JLC represents 70,000 mineral owners in New York State whose mineral rights have been destroyed by political delays orchestrated by Governor Cuomo, Commissioner Martens and Commissioner Shah. It is a travesty that the property rights of landowners have become a political pawn in the effort of Governor Cuomo to get reelected by an overwhelming majority.
This case, which raises the same issues that have been raised in the case brought by the Norse Energy Bankruptcy Trustee and James Lobdell, will be heard on March 7, 2014, the same return date as the Norse case. We are hopeful that the courts of New York State will recognize that the time is long overdue to issue the final standards to allow the development of our clean burning, indigenous shale resources.
